RENEWAL TERMS
I understand that at the conclusion of the term, my membership will automatically be renewed for the same membership type and term. I further understand that my membership dues may increase at each renewal anywhere from 0% to 5%. If I choose to cancel my membership, I must follow the cancelation policy of 30-day written notice prior to next billing date.
CANCELLATION POLICY
All J membership cancellations require a 30-day written notice prior to your next billing date. Submit your written communication via mail (Jewish Community Center of Greater Kansas City, 5801 W 115th, Suite 101, Overland Park, KS 66211), email ([email protected]) or delivered in person to the Member Care Specialist.
If on a membership with an annual term agreement, cancellation options are as follows, with 30-day written notice.
- If you move 25 miles or more from the Jewish Community Center of Greater Kansas City's location, and have proof that you reside at that new address (i.e. lease agreement, utility bill, or employment paperwork).
- If a medical condition stated by a physician inhibits you from completing the remaining term of your contract. It is required that you have documentation signed and dated by your primary physician that states you are unable to utilize our facility for remainder of your contract term. A 30-day notice prior to your next bill date is still required yet a cancellation fee is not required.
- A 40% buy-out of the remaining months on your term after the 30-day notice, to be paid prior to your final monthly billing.
If on a month-to-month agreement, cancellation requires a 30-day written notice prior to your next billing date.
Access to The J continues through the end of the month of your final billing date.
Each year when the membership automatically renews, you will be notified of any change in the membership rate. The J recommends that you consult your physician prior to beginning any exercise or weight loss program.
3 Day Cancellation: If you determine that you do not want to remain a Member, OR wish to revoke this agreement, you may cancel by midnight of the third business day after the day you sign this agreement, with a written notice stating your desire to cancel (a business day is any day the facility is open for business). This notification must be mailed to the following address: 5801 W 115th, Suite 101, Overland Park, KS 66211 or delivered to The Jewish Community Center of Greater Kansas City.
MEMBERSHIP POLICIES AND FACILTIY RULES AND REGULATIONS
The following Membership Policies and Rules and Regulations (“Rules and Regulations”) are a part of the Membership Agreement. You, the Member, agree to abide by the Rules and Regulations and other rules as posted which may vary depending on the services offered. The J may change the Rules and Regulations without notice at any time. The J will post any such changes as appropriate. The Rules and Regulations apply to Members as well as their family members, guests, and invitees (collectively, “guests”) while in, on or about The J premises.
- Upon entering the facility, all Members are required to present their active membership card or driver’s license, or other government issued picture identification. Without the membership card or proper identification, The J may prohibit your use of the facilities or may charge a guest fee for use of the facilities for that day.
- During use of the facilities, all Members and guests will refrain from engaging in loud, foul or slanderous language or molesting, badgering or harassing other J Members, employees, agents and contractors.
- Members and guests will abide by and fully comply with the The J dress code for proper attire on the Center premises. In addition, for safety reasons, The J may post recommended, but not required, attire. For example, The J recommends shower shoes or sandals in all wet tile areas and eye guards during racquetball activities.
- No Member or guest may coach or train other Members or guests (as determined solely by The J). Members may not engage in any type of business or enterprise while at The J.
- From time to time, The J may permit independent contractors to offer products or services to Members. The J does not stand behind or in any way make any representations or warranties concerning, or guarantee the quality or reliability of, these products or services, including whether or not these independent contractors will remain in business for any period of time.
- Each member understands and agrees that The J is not liable to Member or guests for any personal property that is lost, damaged or stolen while on or around The J premises, including but not limited to, any vehicle or its contents, or any property left in a locker.
- Members and guests may not bring illegal drugs or alcoholic beverages onto The J premises.
- Cell phone usage and photography is prohibited in the locker rooms.
- Members and guests will abide by any additional J rules and regulations posted at The J.
- Member is liable to The J for any facility damage intentionally caused by Member and Member’s guests.
- The J may suspend or terminate Member’s right to use the facilities and services if Member or Member’s guests violate this Agreement or engage in other misconduct in or about The J facility.
- The J reserves the right to terminate the membership for any reason whatsoever upon written notice and a refund of the pre-paid dues, if any.
- The J reserves the right to photograph or videotape members and guests and use these materials for marketing purposes, including, but not limited to, insertion on The J website, social networking, program guide and other promotional materials.
IMPORTANT: RELEASE AND WAIVER OF LIABILITY AND INDEMNITY
You hereby acknowledge and agree that use by Member and/or by Member’s spouse and/or by minor children of The Jewish Community Center of Greater Kansas City (The J) facilities, services, equipment, or premises, involves risks of injury or illness to persons and property, including those described below, and Member assumes full responsibility for such risks. Risk of injury or illness includes (but is not limited to): injuries arising from use by Member or others of exercise equipment and machines; injuries arising from participation by Member or others in supervised or unsupervised activities or programs at The J; injuries and medical disorders arising from exercising at The J such as heart attacks, strokes, heat stress, sprains, broken bones, and torn muscles and ligaments, among others; and accidental injuries occurring anywhere in The J dressing rooms, showers and other facilities; illness including any airborne or contact colds, flus or diseases. Member further expressly agrees that the foregoing release, waiver, and indemnity agreement is intended to be as broad and inclusive as is permitted by the law of the State of Kansas and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full force and effect. Member has read this release and waiver of liability and indemnity clause, and agrees that no oral representations, statements, or inducement apart from this Agreement have been made.
